Who We Are


The Partnership for Educational Choice is a strategic alliance formed between the Institute for Justice (IJ) and EdChoice. IJ has long been the nation’s leader in the legal defense of educational choice programs, and EdChoice has long been one of the nation’s premier research and policy organizations fighting to secure programs that empower parents to direct their children’s education. Through the Partnership for Educational Choice, EdChoice will, in time, assume the litigation role that IJ has played in the educational choice movement, enabling IJ to embark on new litigation aimed at defending parental freedom and the rights of education entrepreneurs.

As states continue to innovate, sound legal counsel is necessary to create new, legally sound choice programs.  And as legal battles become more state-centered, a strong legal defense is necessary to ensure these programs can continue to provide the opportunity they offer. The Partnership for Educational Choice is poised to provide this legal counsel and defense—ensuring that educational choice remains legal and accessible to as many families as possible

Institute for Justice

The Institute for Justice, since its inception in 1991, has been committed to establishing the constitutionality of educational choice programs. Over three decades, IJ attorneys have been the lawyers for the educational choice movement, providing the counsel necessary to enact legally sound choice programs and a robust defense of those programs when challenged by opponents of parental choice in court. IJ has secured numerous legal victories, including four at the U.S. Supreme Court. These victories have resolved the major federal and many of the common state constitutional questions concerning educational choice programs, firmly establishing their legality. 

IJ will continue its vital work in educational freedom throughout the transition and beyond, increasingly focusing on tackling government-imposed barriers to education entrepreneurship and parental freedom in education.

EdChoice, carrying forward the legacy of Milton and Rose Friedman, has been committed over the past 27 years to educating about the methods and merits of empowering parents with the ability to choose any educational option for their children. As part of the Partnership for Educational Choice, EdChoice will gradually assume more responsibility for the legal counsel and defense necessary to establish, protect, and grow educational choice programs. This transition will leverage EdChoice’s deep understanding of state-law issues, its extensive experience in expanding educational opportunities, and its robust relationships throughout the states.
